The short version
- You must be 21 or older, and of legal age to buy nicotine where you live.
- $14.99 once gets you lifetime access to Nicky's paid features when the iOS app launches.
- Nicky is a habit tool, not medical advice or treatment.
- Refunds are covered by our Refund Policy.
1. Who we are
Nicky ("Nicky", "we", "us") is an app and website at starvenicky.com, operated by Rasul Ismoilov, an individual based in Uzbekistan. You can reach us at hello@starvenicky.com.
By using this website or buying founding member access, you agree to these terms. If you don't agree, please don't use the site or buy.
2. Who can use Nicky
You must be at least 21 years old, and at least the legal age to buy nicotine products where you live, to use this website or buy founding member access. Nicky is not intended for anyone younger.
3. Founding member early access
Nicky is an iOS app that is still in development. Founding member access is a one-time purchase made before the app is released. It includes:
- Lifetime access to the paid features of the Nicky iOS app, with no subscription, for as long as we operate the app.
- An invite to the TestFlight beta before public launch, when the beta is ready.
- Your first name or a nickname of your choice in the app's founders list, if you want it there. You can opt out at any time.
Your access is personal to you and can't be resold or transferred. We'll tell you by email how to unlock it in the app, for example by signing in with the email you used at checkout.
"Lifetime" means the life of the Nicky app, not your lifetime or ours. The app will need iOS and a compatible iPhone. Features described on the website reflect our current plan. We may change, add or remove features as we build, but the core of the app (a quit plan, a craving (SOS) tool and progress tracking for nicotine pouches) will be included.
Beta versions may have bugs and may lose data. Please don't rely on a beta for anything important.
4. Payment
Our order process is handled by our online reseller and merchant of record, Lemon Squeezy, which processes payments, handles sales tax and VAT, and issues receipts. Lemon Squeezy's own buyer terms also apply to your payment. Prices are shown in US dollars, and taxes may be added at checkout depending on where you live.
Any in-app purchases made later through the App Store are billed by Apple and are also subject to Apple's terms.
5. Refunds
Refunds, including what happens if the app doesn't launch, are covered by our Refund Policy, which is part of these terms.
6. Not medical advice
Nicky is a self-help and habit-tracking tool. It is not a medical device, and it does not diagnose, treat, cure or prevent any disease. Content on this website and in the app, including recovery timelines and health information, is general and educational. Individual experiences vary.
Stopping nicotine can cause withdrawal symptoms. Talk to a doctor or pharmacist before quitting, especially if you are pregnant or breastfeeding, have a heart condition, have a mental health condition, or take prescription medication. If you have a medical emergency, call your local emergency number.
7. Acceptable use
Please don't misuse the website or app. That includes trying to break or overload it, copying or reselling it, reverse engineering it, or using it to break the law.
8. Our content
The Nicky name, the Nicky character, the artwork, the website and the app are owned by us and protected by copyright and other laws. Buying access gives you a personal right to use the app, not ownership of it. Nicky is not affiliated with, endorsed by or connected to any nicotine pouch brand or manufacturer. Brand names mentioned anywhere belong to their owners.
9. No warranty
We'll work hard to build something good, but the website and app are provided "as is" and "as available". To the extent the law allows, we make no promises that they will be uninterrupted, error-free, or that they will help you quit. Quitting depends on you; Nicky is there to help.
10. Limitation of liability
To the extent the law allows, we are not liable for any indirect, incidental or consequential losses, and our total liability to you for anything related to Nicky is limited to the amount you paid us in the 12 months before the claim. Nothing in these terms limits liability that can't be limited by law, or your statutory consumer rights.
11. Ending access
You can stop using Nicky at any time. We may suspend or end access for anyone who seriously or repeatedly breaks these terms. If we stop operating the app within 12 months of its public launch, we will refund founding members in full.
12. Changes to these terms
We may update these terms as Nicky grows. If a change materially affects founding members, we'll email you before it takes effect. The date at the top shows when they were last changed.
13. Governing law
These terms are governed by the laws of the Republic of Uzbekistan, without overriding any mandatory consumer protection laws of the country where you live.
